1. Acceptance of Terms
By creating an account on Deka or otherwise accessing or using the Deka application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the app. Deka is operated by Deka, based in Ireland.
2. Eligibility
You must be at least 18 years old to use Deka. By creating an account or using the app, you represent and warrant that you are 18 years of age or older. If we become aware that a user is under 18, we will promptly terminate their account and delete all associated data.
3. Your Account
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering. You may not create accounts on behalf of others, share your account credentials, or transfer your account to another person.
You agree to notify us immediately at getdekaapp@gmail.com if you become aware of any unauthorised use of your account.
4. What Deka Is
Deka is a platform for trading card collectors to manage their collections, share content with other collectors, and buy, sell, or trade cards with other users.
Deka is a platform only. Deka is not a party, buyer, seller, broker, agent, or intermediary in any transaction between users. All transactions are conducted directly between users at their own risk.
5. User Content
You retain ownership of all content you post on Deka, including photos, text, and videos. By posting content, you grant Deka a non-exclusive, worldwide, royalty-free licence to display, distribute, reproduce, and store your content within the app for the purpose of operating and promoting the Deka service.
You are solely responsible for ensuring you have the necessary rights and permissions to post any content you upload. You must not post content that is illegal, infringing, defamatory, abusive, threatening, or otherwise harmful.
We reserve the right to remove any content that violates these Terms, without prior notice.
6. Marketplace and Transactions
6.1 Platform Role
Deka provides a venue for users to connect, communicate, and arrange transactions. Deka does not buy, sell, or trade cards, does not process payments, hold funds, or act as an escrow service, and is not involved in the fulfilment of any transaction.
6.2 User Obligations
When buying, selling, or trading on Deka, you agree to:
- Accurately describe the condition, authenticity, and details of any card you list.
- Honour agreed transactions in good faith.
- Not list counterfeit, stolen, prohibited, or misrepresented items.
- Arrange and pay for shipping independently. Deka recommends tracked and insured shipping but does not require it.
6.3 Payment
All payment terms, methods, and pricing are agreed solely between buyer and seller. Deka does not process payments, hold funds, facilitate any transfer of money, or take commissions on transactions.
6.4 Shipping and Delivery
Users are solely responsible for arranging, paying for, and managing shipping. Deka is not responsible for cards that are lost, damaged, delayed, or stolen in transit.
6.5 Disputes Between Users
Any dispute arising from a transaction — including disagreements over card condition, authenticity, payment, or delivery — is solely between the users involved. Deka is not obligated to mediate, investigate, or resolve disputes between users and accepts no liability for the outcome of any transaction.
However, Deka reserves the right (but not the obligation) to investigate reports of suspicious, dishonest, or fraudulent behaviour, and to take action at its sole discretion, including issuing warnings, restricting features, or terminating accounts.
6.6 Fraud and Scam Prevention
Deka provides trust scores and user reviews to help users make informed decisions. These features are informational tools and do not constitute guarantees of any user's trustworthiness, identity, or intent to complete a transaction.
You are solely responsible for assessing the risk of any transaction. Deka is not liable for any loss — financial or otherwise — resulting from fraudulent, dishonest, or negligent conduct by other users.
Deka may monitor platform activity to identify patterns of suspicious behaviour and may take proactive steps to maintain a safe trading environment. This may include restricting or suspending accounts that exhibit signs of fraud or abuse.
6.7 No Guarantees
Deka makes no guarantees regarding the quality, authenticity, legality, or value of any card listed on the platform, nor the ability, intent, or reliability of any user to complete a transaction.
7. Reviews and Trust
Reviews should be honest, fair, and based on genuine transaction experiences. You must not:
- Post fake, misleading, or incentivised reviews.
- Review your own transactions from alternate accounts.
- Use reviews to harass, threaten, or defame other users.
- Offer or accept compensation in exchange for reviews.
Deka reserves the right to remove reviews that violate these guidelines and to take further action against users who abuse the review system.
8. Card Pricing
Deka may display estimated card values sourced from third-party pricing services such as SportsCardsPro. These values are indicative only and are provided for informational and reference purposes.
Pricing information displayed on Deka does not constitute a valuation, appraisal, guarantee of value, or financial or investment advice. Deka is not responsible for the accuracy, completeness, or timeliness of pricing data, and users should not rely on it as the sole basis for any purchase, sale, or investment decision.
9. Prohibited Uses
You must not:
- Use Deka for any illegal or unlawful purpose.
- Harass, threaten, bully, stalk, or abuse other users.
- Post or list counterfeit, stolen, or prohibited goods.
- Attempt to manipulate pricing data, reviews, trust scores, or search rankings.
- Scrape, crawl, or systematically extract data from Deka.
- Reverse-engineer, decompile, or attempt to access Deka's source code.
- Create multiple accounts to circumvent restrictions, bans, or suspensions.
- Use automated systems, bots, or scripts to interact with Deka.
- Impersonate another user, person, or entity.
- Interfere with or disrupt the integrity or performance of the Deka platform.
10. Platform Safety and Monitoring
Deka is committed to maintaining a safe and trustworthy environment for all users. To support this:
- Deka may monitor activity on the platform to detect and prevent fraud, abuse, and violations of these Terms.
- Deka may take action against users whose behaviour threatens the safety or integrity of the platform, including issuing warnings, restricting account features, or suspending or terminating accounts.
- Deka may cooperate with law enforcement or regulatory authorities where required by law or where we reasonably believe it is necessary to protect the safety of our users or the public.
These measures are intended to protect the Deka community and do not create an obligation on Deka to monitor, investigate, or resolve every report or incident.
11. Account Suspension and Termination
11.1 Termination by Deka
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the platform, other users, or Deka. Examples of behaviour that may result in suspension or termination include, but are not limited to:
- Fraud or scam activity, including failing to deliver items after receiving payment.
- Listing counterfeit, stolen, or significantly misrepresented items.
- Harassment, threats, abuse, or other harmful behaviour directed at other users.
- Manipulation of reviews, trust scores, or marketplace data.
- Creating multiple accounts to evade a prior suspension or ban.
- Repeated negative reviews and a pattern of dishonest or unreliable conduct.
- Any activity that violates applicable law.
11.2 Termination by You
You may delete your account at any time through the app settings. Upon deletion, all associated data will be permanently removed in accordance with our Privacy Policy.
11.3 Effect of Termination
Upon termination, your right to access and use Deka ceases immediately. Sections of these Terms that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) will continue to apply.
12. Intellectual Property
The Deka name, logo, design, and all associated branding are the property of Deka and its operator. You may not use, reproduce, or distribute any of these without prior written permission.
Trading card images, names, and trademarks displayed within Deka belong to their respective owners (including but not limited to Topps, Panini, The Pokémon Company, Wizards of the Coast, and others). These materials are used on Deka for identification and informational purposes only, and their inclusion does not imply endorsement by or affiliation with any rights holder.
13. Limitation of Liability
Deka is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Deka and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the app or any transaction conducted through it.
This includes, without limitation, losses arising from marketplace transactions, reliance on pricing information, user-generated content, unavailability of the service, or the conduct of other users.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or death or personal injury caused by negligence.
14. Indemnification
You agree to indemnify and hold harmless Deka, its operator, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of Deka, your violation of these Terms, or your violation of any third-party rights.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or relating to these Terms or your use of Deka shall be subject to the exclusive jurisdiction of the courts of Ireland.
Nothing in this section affects your rights as a consumer under the mandatory consumer protection laws of your country of residence within the European Union.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, features, or legal requirements. We will notify you of significant changes through the app or via email. Your continued use of Deka after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should stop using Deka and delete your account.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deka regarding your use of the app and supersede any prior agreements or understandings.
